$6.23m withdrawn from CBN with forged Buhari’s signature for fake election observers, EFCC witnesstells court

A witness of the Economic and Financial Crimes Commission (EFCC) on Monday told a Federal Capital Territory (FCT) high court in Abuja how a withdrawal of $6.23 million was made from the Central Bank of Nigeria (CBN) for a purported election monitoring exercise during the 2023 general election under the leadership of Godwin Emefiele, former governor of the apex bank.

Testifying, Chinedu Eneanya, an assistant commander with the EFCC, said investigations showed the funds were taken from the CBN vault under the pretext of paying foreign election observers.

“The investigation revealed that $6.23 million was removed from the coffers of the CBN for purported funding of the foreign observers of the 2023 elections,” Eneanya said.

Eneanya, the 13th prosecution witness, told the court that documents authorising the release of the funds were recovered from the apex bank, while individuals linked to the transaction were questioned.

The EFCC is prosecuting Emefiele on a 20-count amended charge bordering on criminal breach of trust, forgery, obtaining by false pretence, procurement fraud, and conspiracy.

At the centre of the case is the alleged payment of $6.23 million from the CBN vault in 2023 for what the commission described as a “phoney” election observer exercise. Emefiele has denied all the charges.

The witness, while being led in evidence by Rotimi Oyedepo, director of public prosecutions of the federation (DPPF), said the EFCC discovered that signatures attributed to the late President Muhammadu Buhari and Boss Mustapha, secretary to the government of the federation (SGF) at the time, were forged to facilitate the withdrawal.

He said the finding followed a forensic examination of the documents used in processing the payment.

However, under cross-examination by defence counsel, Matthew Burkaa, Eneanya said no forensic test was conducted on Emefiele’s signature.

He also confirmed that none of the five CBN officials who endorsed the internal memo authorising the transaction are standing trial, noting that they were suspended by the bank.

When asked whether investigations showed that Emefiele personally received the funds, the witness said a lawyer, Ifeanyi Omeke, had claimed to have received money on behalf of the former CBN governor.

He added that Emefiele was not questioned on that allegation.

The court subsequently discharged the witness.

Proceedings took another turn when the prosecution failed to present additional witnesses despite the defence indicating readiness to continue.

Oyedepo told the court that it was uncertain whether the remaining witnesses would be available, explaining that subpoenas had not yet been issued, adding that the witnesses were outside the court’s jurisdiction.

He said the witnesses, Jim Obessa and Eloho Okpozikbo, are in Benin and Lagos.

The defence counsel, however, urged the court to foreclose the prosecution’s case if the witnesses fail to appear.

“If the witnesses do not come tomorrow, we will apply that they should be foreclosed… This is an antic for the prosecution to put maximum hardship on the defendant,” he said.

But Oyedepo opposed the request, saying it was an attempt to prevent the prosecution from presenting its case.

The trial judge, Hamza Muazu, asked both parties to reserve their arguments for final written addresses and directed the prosecution to liaise with the court registrar to issue subpoenas.

The case was adjourned to Tuesday for continuation of trial.

Eneanya’s testimony aligns with earlier evidence presented by prosecution witnesses.

In January, Bashirudeen Maishanu, a CBN official, told the court that the $6.23 million was withdrawn in cash in a single day in February 2023 and tagged as payments to foreign election observers.

Also, on February 13, 2024, the former SGF testified that his signature and that of Buhari were forged to approve the release of the funds.

A day earlier, Onyeka Ogbu, a former CBN controller in Abuja, said he received documents bearing approvals from Buhari, Mustapha and Emefiele for the payment.

In March 2024, Bamaiyi Meriga, a forensic expert, also told the court that the documents used for the withdrawal were forged.

Ahead of the verdict, the party leaders reportedly held an emergency strategic meeting on Wednesday night where they reviewed possible outcomes of the judgment and charted the next line of action for the opposition coalition.

2. National Chairman of the African Democratic Congress, ADC, David Mark, has assured party members that the ADC will be on the ballot for all elections in 2027, despite ongoing legal challenges. Speaking on Wednesday night after receiving a briefing from the party’s legal team on the recent judgment of the Federal High Court in Abuja.

3. President Bola Tinubu has appointed Ambassador Bianca Odumegwu-Ojukwu as Nigeria’s Minister of Foreign Affairs, following the resignation of Ambassador Yusuf Tuggar, who stepped down to participate in the 2027 elections. Ambassador Odumegwu-Ojukwu previously served as Minister of State in the Ministry of Foreign Affairs.

The governor, in a statement issued by his spokesperson, Olawale Rasheed, obtained in Osogbo on Wednesday, alleged that elements in Osun APC were bent on subverting the will of the people, having realised that they stood no chance at the polls.

9. Vice President Kashim Shettima has urged leaders and aspirants of the All Progressives Congress (APC) to embrace unity and restraint ahead of primaries and 2027 general elections. In a statement titled “2027: Don’t Pull Down the Roof,” issued in Abuja, Shettima warned that internal divisions could weaken the party’s chances of success.

10. The Inspector-General of Police (IGP), Rilwan Olutunji Disu, has ordered immediate disciplinary action against officers of the Nigeria Police Force involved in the fatal shooting incident in Effurun, Delta State, which led to the death of a civilian, Mene Ogidi. The IGP made this known during a press briefing at the Force Headquarters, Abuja, on Wednesday.

S’court  to deliver judgment in ADC leadership tussle, PDP Ibadan convention Thursday

The supreme court will on Thursday, April 30, deliver judgement in an appeal filed by David Mark, national chairman of the African Democratic Congress (ADC), over the leadership tussle in the country.

The appeal, marked SC/CV/180/2026, was listed for judgement on the website of the supreme court and indicated that the date has been communicated to parties in the suit. According to the notice, the judgement would commence at 2 pm.

Mark, who is leading a faction of the ADC, is challenging the March 12 ruling of the court of appeal, which ordered parties to maintain the status quo ante bellum in a suit instituted by aggrieved party members.

In the appeal, the former senate president argued that the appellate court exceeded its jurisdiction by intervening in what he described as the internal affairs of a political party.

Through his counsel, Jubril Okutepa, a senior advocate of Nigeria (SAN), Mark maintained that disputes relating to party leadership are non-justiciable, urging the court to set aside the judgement.

The respondents in the suit include Nafiu Bala, the ADC factional chairman; Rauf Aregbesola, the Independent National Electoral Commission (INEC); and Ralph Nwosu, former national chairman of the party.

Among the reliefs sought, Mark asked the court to restrain INEC from recognising any leadership outside his faction pending the determination of the appeal.

He also prayed the court to stop the electoral body from making changes to the party’s leadership structure and to stay proceedings in a related suit pending before the federal high court in Abuja.

While INEC did not file any process in support of or against the appeal, other respondents urged the apex court to dismiss the case.

A five-member panel of the apex court reserved judgement after hearing the appeal on April 22, 2026.

The supreme court will also deliver judgement in three appeals seeking to validate the Peoples Democratic Party (PDP) national convention held in Ibadan, Oyo state capital, on November 15 and 16, 2025.

Bayo Onanuga, presidential spokesperson, announced the development on Wednesday.
