Ozekhome, Magu’s lawyer clash over forfeited assets, anti-graft war

Senior Advocate of Nigeria (SAN) Mike Ozekhome and Senior Law lecturer, Wahab Shittu have disagreed on the Federal Government’s anti-corruption efforts and its handling of recovered proceeds of crime, including forfeited assets.

Ozekhome accused the government of disregarding constitutional provisions on rights protection and being selective in its supposed fight against corruption.

He argued that suspended acting EFCC Chairman, Ibrahim Magu was currently experiencing the sought of treatment he had subjected others to, while he claimed to be fighting corruption.

Ozekhome faulted the practice where anti-graft agencies were also involved in the management and disposal of forfeited assets and suggested the creation of a separate agency for the management and disposal of seized assets.

Shittu, who is Magu’s lawyer before the Justice Ayo Salami (rtd)-led Presidential Committee currently probing the EFCC, disagreed with Ozekhome and contended that Magu did no wrong as nothing has been found against him.

He argued that rather than criticising the anti-graft efforts, everyone should join hands with the government to ensure an efficient and effective process that guarantees the interest of all.

“We should all come on board in designing an effective and efficient legal framework for the management and disposal of seized and confiscated assets in our country,” he added

Ozekhome and Shittu spoke in Abuja on the theme: “Judicial updates and legislative developments on economic crimes and forfeiture of proceeds of crime,” at the on-going 3rd Annual Criminal Law Conference of the Rule of Law Development Foundation (RLDF).

Shittu faulted the 22-man committee recently inaugurated by the Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami to dispose of assets forfeited to the Federal Government, arguing it is inconsistent with constitutional and statutory provisions.

“Clearly, it’s the statutory responsibility of the EFCC under the EFCC (Establishment) Act 2004, a creation of the National Assembly, to carry out the actual disposal of all forfeited assets secured through valid final orders of the court.

“For the avoidance of doubt, Section 31: (1) and subsections (2), (3), (4) and (5) on Final Disposal of Forfeited Property of the EFCC (Establishment), Act 2004, are very clear and unambiguous on how forfeited properties can be sold.

“What is left is to humbly request the HAGF (Attorney General of the Federation) to either propose an executive bill to amend the EFCC Act 2004 before inaugurating the committee and instantly disband the Day Apata SAN-led committee for being in contravention of the law.

“Interestingly, one of the reasons my client, Ibrahim Magu is being probed by the Justice Salami-led Judicial Commission of Inquiry is for alleged failure to follow the law in the disposal of forfeited assets. This allegation is part of several other allegations against Magu, which collapsed during the proceedings.”

Shittu urged that National Assembly to urgently pass the Proceeds of Crime Bill to help harmonize and consolidate existing legislative provisions on the recovery of proceeds of crime and related matters in Nigeria.

“This is essential with a view to addressing the problem of lack of transparency and accountability associated with the management of recovered funds by anti-graft agencies in the country. There appears to be a lack of clarity in addressing this strategic problem in the country currently,” he said.

On how the country could make headway in the fight against corruption, Ozekhome called for the sincerity of purpose on the part of the FG, which he accused of being discriminatory in its approach.

He called for the scrapping of the Presidential Advisory Committee Against Corruption (PACAC), which he claimed is one of those clogs in the wheel of progress in the government’s anti-corruption efforts.

Ozekhome asked the government to stop appointing police personnel to head the EFCC and to discard the current “obnoxious practice of naming and shaming” those accused of corruption.

He added: “The giving and taking of money is a lesser form of corruption when you compare it with favouritism, nepotism, sectionalism in recruiting certain people to the disadvantage of the other contrary to chapter two of the Constitution.

“In a government where the entire security architecture of the country resides in one section of the country, and then, you are talking of corruption? What corruption can be worse than that?”

Tinubu arrives Lagos to flag off construction of Lagos-Calabar highway

President Bola Tinubu has arrived in Lagos ahead of the flag-off of the construction of the Lagos-Calabar highway.

 

The president was received by Babajide Sanwo-Olu, the governor of Lagos, and other government officials at the Murtala Muhammed Airport.

 

On Friday, Dave Umahi, minister of work, said the Tinubu will kick off the road’s construction on May 26.

 

Olusegun Dada, special assistant on social media to the president, said Tinubu will inaugurate some projects ahead of his first anniversary in office.

 

At a meeting with a delegation of Yoruba leaders of thought at the State House in Abuja on Friday, Tinubu said his administration will do all it takes for the average Nigerian to feel the impact of governance.

 

He said the country is no longer “bleeding” but moving into prosperity, adding that the last 12 months of his administration have been “fulfilling”, despite some challenges.

Tinubu resisted pressure to interfere in my reinstatement as Emir – Sanusi

Muhammadu Sanusi says President Bola Tinubu did not interfere in his reinstatement as Emir of Kano. 

 

On Thursday, Abba Yusuf, governor of Kano, announced the reinstatement of Sanusi after signing the new Kano Emirate Council Law.

 

The state assembly had passed the amended Kano State Emirate Council (Repeal) Bill 2024.

 

The law repealed the 2019 version, which balkanised the Kano emirate into five jurisdictions and was relied upon to depose Sanusi as Emir in 2020.

 

Speaking on the development in an interview with Television Continental (TVC), Sanusi said Tinubu recognised that the Kano drama was a local matter and resisted all pressure to interfere.

 

The former governor of the Central Bank of Nigeria (CBN) added that he was not given an opportunity to defend himself after being dethroned on “unsubstantiated allegations”.

 

He described his return to the throne as a correction of injustice done to the people, culture and tradition of Kano.

“As you know, I was appointed the 14th Emir of the single emirate of Kano in June 2014 and now I am reappointed as the Emir of the single emirate of Kano,” he said.

 

 

“In between that period, we did not have a single emirate. We had five balkanised emirates and this was an injustice to the history of Kano. It was an attack on our history, our culture, on our traditions, and it was an act of betrayal to our family.

 

 

“We thank Allah that today, the emirate has been unified again, its people have been brought together, that an injustice has been corrected because as you know, I was dethroned on an allegation of insubordination which was never specified.

 

“I was never given an opportunity to defend myself but I have never spoken about it because I’ve always assumed that when the time is up, it’s up. Today, I thank God that God has remained as we know, a faithful God who stands by justice.

“I would also like to express my thanks to his excellency Alhaji Asiwaju Bola Ahmed Tinubu without whose principled stance of non-interference in the internal affairs of the state, this would not have been possible.

 

 

“The president has shown that he is a respecter of the constitution and the separation of powers, he recognises that this is a purely local matter and that the government has a responsibility to do what is right for the state.

 

“I’m aware that he has resisted all pressure to get the federal government to be involved.

 

“This for me is a continuation of service that I started, it is also an opportunity God has given me to improve on my previous tenure.

 

“We all learn from our mistakes and it is our responsibility to improve on the things we did well and avoid those things we did not do well. Life is a continuous learning process. I’ve enjoyed the break of the last four years.”

He also thanked the Kano state government and the security agencies for maintaining law and order in the state.

He assured the state and federal government of his loyalty and cooperation, saying “they can be assured that they would find in me a friend, confidante and adviser”.

BREAKING: Dethroned Emir breaks silence, says ‘Nobody is above the law’

Alhaji Aminu Ado Bayero, the 15th Emir of Kano, has said no one is above the law, calling on the people to remain calm.

 

Speaking at the mini-palace where he has been since his return to the state after his dethronement, he said justice would prevail.

 

The monarch vowed to accept whatever the law states, adding that Kano is an important state in Nigeria.

 

Speaking in Hausa, he said, “I call on the people to remain law-abiding while awaiting outcome of the legal process in this tussle.

 

“We call on  the authority to do justice in this matter. Kano is a very influential state in Nigeria. Whatever affects Kano affects Nigeria. May peace reign in Kano. We pray for Allah to bless Kano with responsible and just leaders. Justice is the way to go on every issue. There will be justice. Nobody is above law. We will accept whatever the law says. I appreciate all the people who have shown concern.
