UPDATED: Supreme court reserves judgement in FG’s suit seeking full LGA autonomy

The supreme court has reserved judgment in the suit seeking full autonomy for Nigeria’s 774 local governments.

 

All 36 states of the federation are the defendants in the suit marked SC/CV/343/2024.

 

The federal government is also asking for an order preventing the governors from arbitrarily dissolving democratically elected councils.

 

We have an originating summons dated and filed 20 May, 2024.

 

At the court session on Thursday, all the states, represented by their attorneys-general and lawyers, adopted their respective processes and prayed the court to dismiss the suit.

 

Some of the states also said they were being denied fair hearing adding that the attorney-general of the federation (AGF) failed to serve them with the process of his further affidavits filed on June 10.

 

In his submission, Lateef Fagbemi, attorney-general of the federation (AGF), prayed the court to dismiss all preliminary objections filed by the states and grant the originating summons.

“I adopt and rely on these processes. I urge my lords to overrule the various objections and grant the originating summons,” the AGF said.

 

On the issue of fair hearing, the AGF said he sent copies of the affidavits to the defendants via WhatsApp and emails. He said the court bailiff also served the defendants.

 

After listening to the lawyers in the suit, a seven-member panel of justices, led by Garba Lawal, said a date for judgment will be communicated to the parties.

 

BACKGROUND

It is commonplace for governors to sack elected councils and impose caretaker committees in their stead.

 

In the suit filed by Fagbemi, the federal government also requested the supreme court to authorise the direct transfer of funds from the federation account to local governments — in accordance with the constitution.

 

The suit is hinged on 27 grounds.

 

“That the constitution of Nigeria recognizes federal, states and local governments as three tiers of government and that the three recognized tiers of government draw funds for their operation and functioning from the federation account created by the constitution,” the originating summons reads.

“That by the provisions of the constitution, there must be a democratically elected local government system and that the constitution has not made provisions for any other systems of governance at the local government level other than democratically elected local government system.

 

“That in the face of the clear provisions of the constitution, the governors have failed and refused to put in place a democratically elected local government system even where no state of emergency has been declared to warrant the suspension of democratic institutions in the state.

 

“That the failure of the governors to put democratically elected local government system in place is a deliberate subversion of the 1999 Constitution which they and the President have sworn to uphold.

 

“That all efforts to make the governors comply with the dictates of the 1999 Constitution in terms of putting in place a democratically elected local government system, has not yielded any result and that to continue to disburse funds from the federation account to governors for non existing democratically elected local governments is to undermine the sanctity of the 1999 constitution.”

The federal government asked the apex court to invoke sections 1, 4, 5, 7 and 14 of the constitution to declare that the governors and state houses of assembly are under obligation to ensure democratically elected systems at the third tier.

Cholera outbreak: Death toll rises to 37 as Lagos records 401 cases

No fewer than 37 deaths have been recorded in the current Cholera outbreak, which has hit 30 states, including Lagos and Ogun.

 

The Special Adviser to the Lagos State Governor on Health, Dr Kemi Ogunyemi, in a statement on Thursday by the Director of Public Affairs in the state Ministry of Health, Tunbosun Ogunbanwo, said the state had recorded an additional six cholera deaths as against the previous 15.

 

She said cholera cases had risen to 401 in the state.

 

On her part, the Ogun State Commissioner for Health, Dr Tomi Coker, said that the state had recorded one death and 14 cases.

 

The Nigeria Centre for Disease Control and Prevention, in its recent report, said from January 1 to June 11, 2024, over 1,141 suspected and over 65 confirmed cases of cholera, resulting in over 30 deaths, had been reported from 96 local government areas in 30 states.

 

With the six additional deaths in Lagos, and one death in Ogun, the fatalities are no fewer than 37.

 

On Tuesday, the World Health Organisation, the United Nations Children’s Fund, and the International Organisation for Migration held an emergency meeting in Lagos over the cholera outbreak in the country.

Cholera is a food and water-borne disease caused by ingesting the bacteria— Vibrio cholerae— in contaminated water and food. Cholera can cause severe acute watery diarrhoea, and the severe forms of the disease can kill within hours if left untreated.

 

In Nigeria, cholera is an endemic and seasonal disease, occurring annually mostly during the rainy season and more frequently in areas with poor sanitation.

 

Giving the situation report in Lagos on Thursday, the Special Adviser to the Governor on Health, Ogunyemi, stated that Lagos Island remained the epicentre of the outbreak.

The special adviser, who stated this in the statement by the Director of Public Affairs in the state Ministry of Health, Ogunbanwo, recalled in the last update, that the state recorded 350 cases and 15 deaths.

 

The statement partly read, “Following the last update on the cholera outbreak in Lagos, which reported 350 suspected cases and 15 fatalities, the Special Adviser to the Lagos State Governor on Health, Dr Kemi Ogunyemi, disclosed that the total number of cholera cases has increased to 401 across Lagos, with Lagos Island, Kosofe, and Eti Osa recording the highest numbers.

“Dr Ogunyemi revealed this today while providing an update on the outbreak after meeting with members of the Lagos State Public Health Emergency Operations Centre. She added that the death toll had also risen to 21, an increase of six from the previously reported 15 fatalities.”

According to Ogunyemi, the rise in cases was anticipated following the Sallah festivities, during which large gatherings occurred.

 

She, however, noted that suspected cases were subsiding across local government areas, particularly in previously affected LGAs due to the state government’s interventions and surveillance efforts.

 

The Special Adviser stated that the government, through the Ministry of Health and other sister agencies, was maintaining rigorous surveillance and monitoring of the situation and implementing planned programmes and activities to curb the spread.

 

She advised that citizens seek medical attention immediately if they experience symptoms such as watery diarrhoea, vomiting, abdominal pain, general malaise, and fever, stressing that cholera treatment is provided free of charge at all public health facilities

 

In Ogun State, a 62-year-old woman in Ijebu-Igbo has died of cholera.

 

It was gathered that the outbreak which occurred three days ago, also left five other persons hospitalised.

The deceased, it was gathered contracted the disease from her son who is now among those hospitalised.

 

The state commissioner for Health, Coker confirmed the incident to one of our correspondents on Thursday.

 

Coker said 14 cases of cholera had been reported from four local government areas; Ota, Abeokuta South, Obafemi Owode and Ijebu North.

 

According to her, five other persons had also been hospitalised.

 

She stated, “A 62-year-old lady who contracted cholera from her sick son died in Ijebu Igbo. Five others have also been hospitalised across four local government areas of Ota, Abeokuta South, Obafemi Owode, and Ijebu North

 

“The cumulative total cases since last week are 14 with one fatality”, Coker said.

 

She urged residents of the state to maintain good hygiene and avoid drinking water from unknown sources.

 

“I want to call on Ogun people to keep calm and be on the alert for anyone with the symptoms of cholera. They should report any suspected case of cholera to our disease surveillance team”, Coker said.

UPDATED: Kano Govt orders Bayero to vacate mini palace

The Kano State Government has ordered the police to remove the 15th Emir of Kano, Alhaji Aminu Ado Bayero from the Nassarawa mini palace.

 

Governor Abba Kabir Yusuf had issued a similar directive when Ado Bayero returned to the state two days after his dethronement.

 

Angered by the development, the governor had ordered the police to arrest the dethroned monarch whom he accused of fueling tension.

 

However, more soldiers were deployed in the mini palace to provide security for Ado Bayero.

 

Weighing in on the issue at the time, Mohammed Gunel, Commissioner of Police, had said the police would obey the order which restrained Kano government from reinstating Alhaji Muhammadu Sanusi.

 

He had said, “The Police Command is expressly obeying the Court Order with SUIT No. FHC/KN/CS/182/2024 Dated 23rd May, 2024 issued by the Federal High Court sitting in Kano alongside ail Law Enforcement agents in the State.”

But addressing journalists at Government House, Kano, on Thursday, the State Attorney General and Commissioner for justice, Barrister Haruna Isah Dederi, said the dethroned monarch should be evicted because all is set for the reconstruction and renovation of the property.

 

He said, “By the ruling of the Court, it has unequivocally. reaffirmed the validity of the law passed by Kano State House of Assembly and assented to by His Excellency the Executive Governor of Kano State on Thursday 23rd May, 2024 by 5:10pm. This part of the judgement is very fundamental to the entire matter.

 

“Further implication of the ruling is that all actions done by the Government before the emergence of the interim order of the honorable Court, are equally validated. This means that, the abolishing of the Five emirates created in 2019 is validated and the deposition of the Five emirs is also sustained by the Federal High Court. By implication this means that Muhammadu Sanusi II remains the emir of Kano.

“Following this Court’s ruling, Kano State Government has directed the State Commissioner of Police to remove the deposed emir of the 8 metropolitan local governments from the Government property where he is trespassing as Government has already concluded arrangements for the general reconstruction and renovation of the property including the demolishing and reconstruction of the dilapidated wall fence with immediate effect.”
